Accessory uses - R3

Development Requirements:
Accessory uses customarily incident to any of the above uses, and located on the same lot not involving the conduct of a business or industry.

There shall be permitted such facilities as are customarily accessory to the operation of an apartment hotel when conducted and entered from within the building.
Private or storage garages, located as provided in district R-1 for private garages, may provide space for not more than one motor vehicle for each 750 square feet of lot area. No business occupation or service connected with motor vehicles, except washing occupant autos, shall be permitted.

Adult daycare

An adult daycare facility licensed under RSMo § 660.403 or accepted from licensure requirement by RSMo § 660.405.

Agriculture general

The planting, cultivating, harvesting and storage of grains, hay or plants commonly grown in the county. The raising and feeding of livestock and poultry shall be considered an agricultural venture if the area in which the livestock or poultry is kept is ten acres or more in area, and if such raising of livestock and poultry is incidental or supplemental to the raising of crops.

Animal hospital

Hospital for small animals if within an enclosed building.

Armories or assembly halls

Automobile parking lots

Automobile parking lots (patron parking only)

Parking lot is for the use of patrons only.

Automobile sales & storage

Automobile parking lots, Automobile sales rooms and used car lots including repair facilities when appurtenant to such sales activity, Storage garages for automobiles.

Bakeries

Banks, savings, and loan establishments

Boardinghouse or lodginghouse

A building other than a hotel, where rooms and meals are provided as part of a prearranged agreement to one or more persons who are not related by blood or marriage to the person providing room and meals.

Book, periodical, and newspaper merchant

Includes newstands, printing and publishing plants, including bookbinding.

Broadcasting

Radio and television broadcasting stations and studies, except towers.

Bus passenger station

Child day-care center

A building or part thereof operated or maintained by any person or establishment who holds themselves out as providing child care for more than four children not related to the day care provider for any part of the 24-hour day without overnight stays, for compensation or otherwise, except those operated by a school system or in connection with an establishment providing child care as a convenience for its customers or employees. A child day-care center shall not include any private or religious organization, elementary or secondary school, a religious organization academic preschool or kindergarten, home school, or a family home occupied by the day care provider where child care is given to not more than four children not related to the day care provider. Child day-care centers shall be state certified.

Church or religious institution

Clinic

Dental or medical, allowing overnight patients only in emergency cases.

Custom work shops

Vehicle Parking:

Development Requirements:
Provided that in such manufacture the space occupied by the manufacturing permitted herein shall not exceed 50 percent of the total floor area of the entire building; and further provided that such manufacturing use does not emit any vibrations, noise, odor, dust, noxious gas, smoke, particulate matter, glare or heat detectable outside of the building.

Distilleries, laboratories, mills, plants & shops

Ammonia, bleaching powder or chemical plants, Asphalt and concrete mixing plants, Assaying works (other than gold or silver), Blooming or rolling mills, Breweries or distilleries, Chemical laboratories, Cider mills, Coal car dumps, Coal distillation and by-products plants, Coal hoists, pockets or treaties, Coke ovens, Cooperage works and stave mills, Cotton ginning or bailing works, , Enameling works, Electric power plants, Electroplating, Forges, Foundries (iron, brass, bronze, aluminum), Hides and skins (storage, curing or tanning), Japanning works, Lumber mills, Machine shops, Metal stamping, shearing, punching works, etc, Monument or marble works, Planing mills, Plumbing and sheet metal shops, Railroad roundhouses or shops, Salt works, , Steel furnaces, Stone cutting, Structural iron or pipe works, Sugar refineries, Tar distillation or manufacture, Wire or rod mills, Wood distillation plants (charcoal, tar, turpentine, etc,), Wool scouring works, Insulation manufacturing plant,

Dog kennels & pounds

A shelter for a dog or cat, an establishment for the breeding or boarding of dogs or cats.

Drive-in restaurants

Includes ice cream shops, refreshment stands, etc where persons are served in automobiles.

Dwelling, multiple

A building or portion thereof, arranged, intended or designed for occupancy by three or more families, including apartment houses, row houses, tenements and apartment hotels.

Dwelling, one-family

A detached building arranged, intended or designed for occupancy by one family.

Dwelling, two-family

A building arranged, intended or designed for occupancy by two families. Including townhouses designed for occupancy by two families.

Entertainment facilities w/ alcohol

Dance halls, shooting galleries, skating rinks, gymnasiums, amusement centers and similar commercial recreation buildings or activities; businesses which sell liquor, intoxicating beer or nonintoxicating beer for consumption on the premises.

Vehicle Parking:
Determined on a case-by-case basis

Development Requirements:
Provided that no part of such building shall be less than 300 feet from any part of the building of an existing clinic, hospital, school or church; and shall not be less than 200 feet from a district R-1 to R-3, inclusive; and further provided that places offering sale of intoxicating or nonintoxicating beer or liquor for consumption on the premises shall be subject to the provisions of section 3-15.

Factories, plants & mills

Bottling works, Canning or preserving factories, Chemical laboratories not producing noxious fumes or odors, Cleaning, pressing and dyeing plants, Fabrication or assembling of irrigation pipe and equipment, Flour mills, feed mills and grain processing, Galvanizing works, Grain elevators, Ice plants, Laundries and dry cleaning plants, Lumber yards, Machine shops, Milk bottling or dairy product processing, Monument or marble works, finishing and carving only, excluding stone cutting, Photo engraving plants, Planing mills, Sign painting plants, Cellulose insulation manufacturing plant.

Vehicle Parking:
1 space for each 1.5 employees and sufficient off-street parking space for customers, visitors, and others who may spend time at the establishment during working hours as deemed necessary by the planning commission and city council.

Merchandise Loading:
Adequate facilities for the loading and unloading of merchandise and goods within or adjacent to the building, in such a manner as not to obstruct freedom of traffic movement on the public streets, alleys or sidewalks

Family day care home

A child care program where care is given by a person licensed by the state division of family services as a family day care home provider for no more than ten children not related to the provider for any part of the 24-hour day. For the purposes of this definition, a child is a person under the age of 17. See RSMo § 210.210.

Feed stores

A store selling feed for animals or livestock.

Food service

Includes candy store, catering service, cafeteria, confectionery, delicatessen, food market, frozen food lockers for individual or family use, ice cream parlor where persons are served inside the building only, juice bar or shop, package liquor and beer sales, but not taverns, pastry shop, tea room.

Restaurants: this includes restaurants that hold valid licenses issued by the state under RSMo § 311.095, except that restaurants that hold such licenses shall not be located within 300 feet of any school, church or other building regularly used as a place of religious worship as provided in RSMo § 311.080.2.

Freight & storage

Bus barns or lots, Freight terminals (rail or truck), Moving, transfer or storage plants, Railroad freight yards, Yards and service for contractor's equipment, oil well supplies and related Sales rooms, Tracks (team, loading or storage).

Vehicle Parking:
1 space for each 1.5 employees and sufficient off-street parking space for customers, visitors, and others who may spend time at the establishment during working hours as deemed necessary by the planning commission and city council.

Merchandise Loading:
Adequate facilities for the loading and unloading of merchandise and goods within or adjacent to the building, in such a manner as not to obstruct freedom of traffic movement on the public streets, alleys or sidewalks

Gas stations

Filling stations; provided that all gasoline storage tanks are located below the surface ground.

General industries

Auction establishments and sales pavilions, Carpenter, cabinet or pattern shops, Carpet cleaning establishments, Creameries.Dog pounds (if within an enclosed building), Hatcheries, Plumbing and sheet metals shops (allowing punching of material of one-eighth inch or less in thickness), Produce markets (wholesale), Stables (public) or wagon sheds.

Vehicle Parking:
1 space for each 1.5 employees and sufficient off-street parking space for customers, visitors, and others who may spend time at the establishment during working hours as deemed necessary by the planning commission and city council.

Merchandise Loading:
Adequate facilities for the loading and unloading of merchandise and goods within or adjacent to the building, in such a manner as not to obstruct freedom of traffic movement on the public streets, alleys or sidewalks

Golf courses

Including clubhouses appurtenant thereto, except miniature golf courses, driving ranges and other similar activities operated as a business; provided that no clubhouse, swimming pool or parking area shall be closer than 100 feet to a property line.

Greenhouses & seed stores

Greenhouses for commercial use. Seed stores selling seeds for flowers, fruits and vegetables .

Group day care home

Whether known or incorporated under another title or name, a child care program where care is given by a person licensed by the state division of family services as a group day care home provider for 11, but not more than 20, children not related to the child care provider for any part of the 24-hour day. A group day care home shall be in a location other than the provider's permanent residence or separate from the provider's living quarters. For purposes of this definition, a child is a person under the age of 17. See RSMo § 210.201.

Development Requirements:
Under the following restrictions:
(1) One off-street parking space shall be available for each provider and employee.
Off-street loading and unloading of children shall be made possible by the provision of a circle drive, a drive through driveway, or other provision approved by the code administrator that does not necessitate the backing of vehicles.
(2) Shall register the location of such facility, before commencing operation, with the city building/zoning official and the city fire chief. The fire chief shall be provided with floor plans of the structure detailing all sleeping rooms and all exits.
(3) Meet or exceed all health, fire, safety and building codes ordained by the city.
(4) Notify immediately the city fire chief or the city police dispatcher if the dwelling is to cease operation as a group day care home or is to become

Group home

Any home in which eight or fewer unrelated mentally or physically handicapped persons reside, and may include two additional persons acting as houseparent or guardian who need not be related to each other or to any of the mentally or physically handicapped persons residing in the home.

Vehicle Parking:
Determined on a case-by-case basis

Development Requirements:
(1) Group homes are limited in density in areas of the city zoned R-1 single-family by physical separation in all directions by a distance of not less than 500 linear feet from property line to property line or 500 linear feet along the shortest legal pedestrian path from the proposed home to an existing group home, whichever is shortest. This provision is intended to avoid over-concentration of group homes in one location which would adversely affect individuals with disabilities and be inconsistent with the objection of integrating persons with disabilities into the community.
(2) Are constructed and maintained having an exterior appearance of the home and property in reasonable conformance with the general neighborhood standards.
(3) Are licensed by the state, if applicable.
(4) Shall register the location of such facility, before commencing operation, with the city building/zoning official and the city fire chief. The fire chief shall be provided with floor plans of the structure detailing all sleeping rooms and all exits.
(5) Meet or exceed all health, fire, safety and building codes ordained by the city.
Notify immediately the city fire chief or the city police dispatcher if the dwelling is to cease operation as a group home or is to become unoccupied. Should a dwelling or structure located in an area zoned R-1 single-family or R-2 two-family cease to operate for the purpose set forth in this subsection, any other use of such home must be consistent with the zoning ordinance of this Code.
(6) Group homes shall be permitted and municipal rules, policies, practices and services will be provided within the City of Nevada in complete conformity will all federal and state laws and regulations, which if inconsistent with any provision of the Municipal Code shall preempt and control.
(7) In all proceedings related to a group home, the city will make "reasonable accommodations" in rules, policies, practices and services when such accommodations may be necessary to afford persons entitled to privileges under the Fair Housing Act, as amended, and any other federal or state law or regulation, the equal opportunity to use and enjoy a dwelling. The concept of "reasonable accommodation" has a long history in regulations and case law dealing with discrimination on the basis of handicap, need not further be defined herein, and will be applied in a manner consistent with said regulations and case law. See e.g., 24 CFR 100.204 and citations.
(8) The definition of group home in section 37-1 of the Code of the City of Nevada, Missouri, is amended to add the following provision: "Handicap" means, with respect to a person a physical or mental impairment which substantially limits one or more of such person's major life activities, or a person who has a record of having such an impairment, or being regarded as having such an impairment, but such term will not include current, illegal use of or current addiction to a controlled substance as defined in Section 102 of the Controlled Substances Act (21 U.S.C. 802, as amended. This exclusion does not eliminate protection for individuals who take drugs defined in the Controlled Substances Act for a medical condition under the care of, or by prescription from, a licensed physician. Individuals demonstrating they are not currently using an illegal drug, are not to be deprived of housing, all as required under the definition of handicap in the Fair Housing Act Amendments.
(9) Nothing in the group home provisions of the City of Nevada will require that a dwelling be made available to an individual whose tenancy would constitute a direct threat to the health or safety of other individuals, unless such threat can be eliminated by reasonable accommodation.

Group homes

Home occupations

The use of a dwelling, or an attached accessory building on the same zoning lot, for commercial activities; these activities must be clearly secondary to the use of the structure as a residential dwelling. Also, the property is located in a residential zoning district.

Development Requirements:
Subject to the following conditions:
• A home occupation shall be located in the dwelling or in the structure attached to the dwelling used by a person as his private residence or a detached structure located upon the same lot as his private residence.
• No assistant, other than a member of the family household, shall be employed and signs shall be limited to one nonilluminated window sign not more than one square foot in area.
• Only electrical power shall be used in any machines used in such home occupation and such power shall not exceed one horsepower per machine or a total of two horsepower excluding customary heating or cooling devices.
• Any permit issued pursuant to this subsection shall be nontransferable and shall be subject to review, upon complaint, by the planning commission, and subject to revocation by the council if revocation is recommended by the planning commission.

Hospitals

Publicly operated hospitals, licensed privately operated hospitals, and nursing homes and convalescent homes supported by said hospitals.

Ice delivery

Ice delivery stations for storage and sale of ice at retail only.

Industries needing Council approval

The following additional uses may be permitted after the location of such uses have been approved by the city council, after report by the chief of the fire department and planning commission:

Acid manufacture, Cement, lime, gypsum or plaster of Paris manufacture, Distillation of bones, Explosives manufacture or storage, Fat rendering, Fertilizer manufacture, Garbage, offal or dead animals, reduction or dumping, Glue manufacture, Petroleum, or its products, refining of Smelting of tin, copper, zinc or iron ores, Stockyards or slaughter of animals, Wholesale storage of gasoline or LP gas.

Vehicle Parking:
1 space for each 1.5 employees and sufficient off-street parking space for customers, visitors, and others who may spend time at the establishment during working hours as deemed necessary by the planning commission and city council.

Merchandise Loading:
Adequate facilities for the loading and unloading of merchandise and goods within or adjacent to the building, in such a manner as not to obstruct freedom of traffic movement on the public streets, alleys or sidewalks

Laundry

Includes dry cleaning establishments and laundries employing not more than five persons on the premises and using nonexplosive cleaning fluids.

Manufacture of products

Such as: artificial flowers, feathers, plumes, awnings, bags, blacking, small boats, bone products, brooms and brushes, buttons and novelties, candy, canvas products, cement products, concrete blocks, chemicals (nonoffensive), cigars, cleaning and polishing preparations, clothing, coffee (roasting), cosmetics, cottonseed, peanut or similar products, drugs or medicines, electrical signs, extracts, food products, fruit juices, gas or electric fixtures, ice cream, leather products, sausage, shell products, shoes and boots, syrup, terra cotta or tile handicraft products, textiles, toys or woodenware

Vehicle Parking:
1 space for each 1.5 employees and sufficient off-street parking space for customers, visitors, and others who may spend time at the establishment during working hours as deemed necessary by the planning commission and city council.

Merchandise Loading:
Adequate facilities for the loading and unloading of merchandise and goods within or adjacent to the building, in such a manner as not to obstruct freedom of traffic movement on the public streets, alleys or sidewalks

Manufacture of products

Manufacturing of such products as: adding machines, cash registers, typewriters, alcohol, asphalt, basket material, boats, boilers, boxes, bronze, burial vaults, cans, carbon batteries, electric lamps, carbon or lamp black, celluloid or plastic materials, petro-chemicals, clay, shale and glass products, creosote, cutlery, or tools, disinfectants, insecticides, dyes, electrical machinery, engines, furniture, glass, iron and steel, locomotives, motor cars, bicycles, airplanes, pumps, nuts, bolts, screws, etc., oil cloth, linoleum, paint, lacquer, oil, turpentine, varnish, enamel, etc., railway cars, rubber, synthetic rubber, rubber products, soap, starch, glucose, dextrin, tar products, tools, vinegar or beverages.

Vehicle Parking:
1 space for each 1.5 employees and sufficient off-street parking space for customers, visitors, and others who may spend time at the establishment during working hours as deemed necessary by the planning commission and city council.

Merchandise Loading:
Adequate facilities for the loading and unloading of merchandise and goods within or adjacent to the building, in such a manner as not to obstruct freedom of traffic movement on the public streets, alleys or sidewalks

Marijuana & cannabis facilities

Cannabis describes cannabis products in general. Marijuana specifically refers to cannabis products that are made from the dried flowers, leaves, stems and seeds of the cannabis plant.

Vehicle Parking:
Determined on a case-by-case basis

Development Requirements:
(1) Medical marijuana cultivation facility. Shall not be located within 500 feet of any then-existing elementary school, secondary school, child day-care center, or church. As used in the previous sentence, "then-existing" shall mean any elementary school, secondary school, child day-care center, or church with a building permit from the city to be constructed, or under construction, or completed and in use at the time the medical marijuana cultivation facility applies for a zoning permit.
(2) Medical marijuana-infused products manufacturing facility. Shall not be located within 500 feet of any then-existing elementary school, secondary school, child day-care center, or church. As used in the previous sentence, "then-existing" shall mean any elementary school, secondary school, child day-care center, or church with a building permit from the city to be constructed, or under construction, or completed and in use at the time the medical marijuana-infused products manufacturing facility applies for a zoning permit.
(3) Medical marijuana testing facility. Shall not be located within 500 feet of any then-existing elementary school, secondary school, child day-care center, or church. As used in the previous sentence, "then-existing" shall mean any elementary school, secondary school, child day-care center, or church with a building permit from the city to be constructed, or under construction, or completed and in use at the time the medical marijuana testing facility applies for a zoning permit.
(4) Medical marijuana transportation facility. Shall not be located within 500 feet of any then-existing elementary school, secondary school, child day-care center, or church. As used in the previous sentence, "then-existing" shall mean any elementary school, secondary school, child day-care center, or church with a building permit from the city to be constructed, or under construction, or completed and in use at the time the medical marijuana transportation facility applies for a zoning permit.

Medical marijuana dispensary facility

A facility licensed by the State of Missouri to acquire, store, sell, transport, and deliver marijuana, marijuana-infused products, and drug paraphernalia used to administer marijuana as provided by the State of Missouri solely pursuant to the terms of Article XIV, Section 1 of the Missouri Constitution to a qualifying patient, a primary caregiver, another medical marijuana dispensary facility, a medical marijuana testing facility, or a medical marijuana-infused products manufacturing facility.

Vehicle Parking:
1 space for each 200 square feet of service floor area in the building, when not located in the C-P or C-2 districts

Development Requirements:
Shall not be located within 500 feet of any then-existing elementary school, secondary school, child day-care center, or church. As used in the previous sentence, "then-existing" shall mean any elementary school, secondary school, child day-care center, or church with a building permit from the city to be constructed, or under construction, or completed and in use at the time the medical marijuana dispensary facility applies for a zoning permit.

Miniature golf

Multiple dwellings - Apartment

Apartment houses or multiple dwellings, or townhouses designed for occupancy by three or more families.Boardinghouses and lodginghouses. Fraternity or sorority houses and dormitories.Apartment hotels.

Nurseries and truck gardens

limited to the propagation, cultivation and sale of plants; provided that no obnoxious fertilizer is stored upon the premises, and no obnoxious soil or fertilizer renovation is conducted thereon. Greenhouses may be constructed by special use permit.

Nursing homes

Homes for convalescents or the aged, other than for the insane or feeble minded or alcoholics or drug addicts

Office buildings

Office buildings to be used only for the administrative functions of companies, corporations, social or philanthropic organizations or societies.
Other offices, limited to the following:
• Accountants.
• Architects.
• Brokers.
• Engineers.
• Dentists.
• Lawyers.
• Physicians, osteopaths or chiropractors.
• Real estate.
• Insurance.
• Psychologist.
• Psychiatrist.
• Mortuaries.

Pop bottling plants

Vehicle Parking:
1 space for each 1.5 employees and sufficient off-street parking space for customers, visitors, and others who may spend time at the establishment during working hours as deemed necessary by the planning commission and city council.

Merchandise Loading:

Private clubs

Private clubs or fraternal orders, except those whose chief activity is carried on as a business.Philanthropic or eleemosynary institutions, other than penal institutions

Private foster care home

Any private residence licensed by the division of family services or department of mental health to provide foster care to one or more but less than seven children who are unrelated to either foster parent by blood, marriage or adoption.

Private foster care homes

Private foster care home means any private residence licensed by the division of family services or department of mental health to provide foster care to one or more but less than seven children who are unrelated to either foster parent by blood, marriage or adoption.

Private stable

Stable, private, means an accessory building for the keeping of horses, ponies or cows, owned by occupants of the premises, and not kept for remuneration, hire or sale.

Public administrative buildings

Including police and fire stations.

Public libraries

Public museums

Public places

Including playgrounds, public recreation or service buildings and swimming pools within such parks;

Public schools

Including elementary and high, and private schools with curriculum equivalent to that of a public elementary or high school, and institutions of higher learning, including stadium and dormitories in conjunction, if located on the campus.

Railroad rights-of-way

Note: not including railroad yards.

Recreation vehicle parks and campgrounds

Development Requirements:
by special use permit only; provided that such yards are completely enclosed and effectively screened by a solid fence or wall at least eight feet high. Stable, public, means a stable other than a private or riding stable.
Stable, riding, means a structure in which horses or ponies, used exclusively for pleasure riding or driving, are housed, boarded or kept for remuneration, hire or sale.

Stable, private, means an accessory building for the keeping of horses, ponies or cows, owned by occupants of the premises, and not kept for remuneration, hire or sale.

Trailer courts & mobile home parks

Trailer or mobile home court means land used or intended to be used, let or rented for occupancy by two or more house trailers or mobiles homes.

Development Requirements:
(1) Each trailer lot shall be not less than 75 feet in size and 3,750 square feet in area.
Each trailer lot shall have connections to a sanitary sewerage system or septic tank to be approved by the city engineer, and to a pure and safe water supply.
(2) The minimum distance between trailers shall be 25 feet, and no trailer shall be located closer than 30 feet to a court property line.
(3) At least 100 square feet of playground area shall be provided for each trailer lot, other than the area of the trailer lot itself; except that no playground shall have an area of less than 2,500 square feet.
(4) All streets and drives in the trailer court shall be paved with asphaltic or Portland cement concrete pavement or a six-inch rolled aggregate base with double asphalt surface treatment.
(5) Mobile home parks shall be approved and licensed subject to other regulations of the city governing such development. However, no such park shall be approved that cannot provide a minimum of 18 trailer spaces, and other necessary spaces such as off-street parking, drives, play area, etc.

Development Requirements:
No dismantled vehicles or parts are displayed or stored outside the building. Storage of junk parts and detached parts from vehicle bodies shall be within a building or an enclosed area fenced with materials such as: tight boarding, metal panels or masonry that effectively screens such area from the view of persons using adjoining streets or highways either on foot or in vehicles. Such fenced area need only be large enough to contain all the above described parts; providing, also, that any business in this classification, existing on November 1, 1994, and made nonconforming by this subsection shall have up to six months from November 1, 1994, to comply.
